DePuy Settles Over Faulty Surgical Hip Implants

Texas Attorney General Ken Paxton recently announced that Texas will receive $8.5 million as part of a $120 million multi-state settlement with DePuy Orthopaedics, a division of Johnson & Johnson. This settlement resolves claims alleging deceptive, unfair marketing of two surgical hip replacement devices. Details on the announced settlement are available here.

The Investigation

An executive committee, including attorneys general from Florida, Indiana, North Carolina, Ohio, Pennsylvania, and Washington, investigated DePuy Orthopaedics. The efforts were led by Texas Attorney General Ken Paxton and South Carolina Attorney General Alan Wilson. States not included in the settlement are Mississippi, New Jersey, Oregon, West Virginia, and Wyoming.

In total, 46 states accused both DePuy Orthopaedics and Johnson & Johnson of making false claims regarding the longevity of their ASR XL and Pinnacle Ultamet surgical metal-on-metal hip implants.

Details on the Settlement

The company first recalled the ASR XL from the market in 2010 and discontinued its Pinnacle Ultamet in 2013. Patients who underwent hip replacements with both devices later went on to issue complaints about a variety of health issues. Under the terms of the settlement, DePuy has agreed to revise how it markets and promotes its hip implants—including the use of current scientific data to support claims it makes in advertising the products.
