New Court Ruling Allows Oil Companies to be Sued When a Worker is Injured or Killed

The Occupational Safety and Health Administration (OSHA) issued a report detailing just how hazardous oil and gas extraction work conditions can be and the fatality rate that goes along with it.

From 2003-2010, 823 oil and gas extraction workers were killed on the job throughout the United States. The fatality rate of oil and gas extraction workers is seven times higher than any other industry in the United States.

After a 2014 workers compensation case involving a truck driver who was severely burned while picking up wastewater from an oil well site in Oklahoma was struck down in Oklahoma’s highest court, many began to question just how unconstitutional the law in place was. The employee died 3 days after the accident due to his injuries.

A new court ruling by the Oklahoma Supreme Court makes it possible for oil and natural gas companies to be sued when an employee is killed or injured on the job.

The Court explained, “the law was unconstitutional because it treated oil and gas differently than other industries, no valid reason exists for the special treatment of the oil and gas industry.”
